TrustBoomers on Medical Liability

Medical Liability costs consumers, particularly in health care, billions in additional costs because of frivolous lawsuits and excessive jury awards. It leads doctors to leave the practice of medicine; drives up the cost of providing care to Americans; and denies access to timely justice for those that are truly deserving of compensation.

  • Congress needs to enact legislation that will place a cap on non-economic damages at no more that $250,000;
  • Impose a cap on attorney’s fees to limit frivolous class action suits driven by greedy trial lawyers;
  • Cap punitive damages with a formula that is tied to no more than a multiple of 2 of the economic damages;
  • Impose a statute of limitations;
  • and, limit liability of each party to the share of damages attributable to their individual conduct.

Until this legislation is enacted, medical liability will continue to drag the entire health care system down; will increase costs and health care insurance premiums; will degrade access to quality of care; and will continue to clog the courts with frivolous lawsuits.
